Terms of Service

These Terms of Service ("Terms") govern your use of the Primed mobile application and related services ("Service") operated by Primed AI Training ("Primed", "we", "our", "us"). By using Primed, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use Primed. By creating an account, you represent that you meet this requirement.

2. Account

• You may sign up using Google Sign-In or Apple Sign-In.
• You are responsible for maintaining the security of your account.
• You may delete your account at any time from the Profile screen, which permanently removes all your data.

3. Description of Service

Primed is a fitness application that:

• Connects to wearable devices (Apple Health, WHOOP) to read health and fitness data.
• Calculates a daily readiness score based on your biometric data.
• Uses artificial intelligence to generate personalized workout plans.
• Tracks your workouts, exercises, and personal records.
• Provides analytics on your training progress.

4. Not Medical Advice

Primed is not a medical device and does not provide medical advice. The readiness scores, workout recommendations, recovery insights, and any other information provided by the Service are for informational and fitness purposes only. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Always consult a qualified healthcare provider before starting any new exercise program, especially if you have any pre-existing health conditions. If you experience pain, dizziness, or discomfort during exercise, stop immediately and seek medical attention.

You use the Service and follow its recommendations at your own risk.

5. Subscriptions and Payments

• Primed offers both free and premium features.
• Premium subscriptions are billed through the Apple App Store.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription in your iPhone's Settings > Apple ID > Subscriptions.
• No refunds are provided for partial subscription periods, except as required by applicable law or Apple's refund policies.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to reverse-engineer, decompile, or extract source code from the app.
• Interfere with or disrupt the Service or its infrastructure.
• Create multiple accounts to circumvent rate limits or other restrictions.
• Share your account credentials with others.

7. Intellectual Property

All content, features, and functionality of Primed (including but not limited to text, graphics, logos, and software) are owned by Primed and are protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.

8. AI-Generated Content

Workout plans and coaching recommendations in Primed are generated by artificial intelligence. While we strive for accuracy and safety, AI-generated content may occasionally contain errors or suboptimal recommendations. You should use your own judgment when following any AI-generated workout plan.

9. Wearable Data

• Primed accesses wearable data only with your explicit permission.
• You may disconnect any wearable device at any time.
• We are not responsible for the accuracy of data provided by third-party wearable devices or platforms.

10. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" and "as available" without warranties of any kind.
• We do not guarantee that the Service will be uninterrupted, error-free, or that readiness scores or workout plans will be perfectly accurate.
• We are not liable for any injuries, health issues, or damages arising from your use of the Service or reliance on its recommendations.
• Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Primed and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may terminate your account at any time by deleting it from the Profile screen.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify you of material changes through the app.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes will be resolved in the courts of the state in which the company is incorporated.
